NC Utilities Commission

NCSEA is the "go to" organization in North Carolina on energy policy. In collaboration with our individual and business members across North Carolina and partner organizations, NCSEA works extensively with the NC Utilities Commission to promote and expand renewable energy and energy efficiency in all regions of our state. 

 

The NC Utilities Commission (NCUC) is a 7-member commission that regulates the rates and services of all public utilities in North Carolina. It is the oldest regulatory body in state government. Today, the Utilities Commission regulates electric, telephone (including payphone service and shared tenant service), natural gas, water, wastewater, water resale, household goods transportation, busses, brokers, and ferryboats. To a limited degree, the Commission regulates electric membership corporations, small power producers, and electric merchant plants. The Commission is also responsible for administering programs in North Carolina to ensure the safety of natural gas pipelines.

On several different occasions, NCSEA’s “intervention” in a docket before the Utilities Commission helped this appointed body rule in favor of a more sustainable energy future.

Renewable Energy and Efficiency Portfolio Standard (REPS) Rulemaking, Docket No. E-100, SUB 113. NCSEA filed comments and successfully overcame opposition to a renewable energy certificate (RECs) tracking system. Working Rules were adopted February, 2008. Biennial Determination of Avoided Cost Rates for Electric Utility Purchases from Qualifying Facilities-2008, Docket No. E-100, SUB 117.
These are the 2008 biennial proceedings held by the NCUC pursuant to the Public Utilty Regulatory Policies Act of 1978 (PURPA) and the Federal Energy Regulatory Commission (FERC) regulations implementing those provisions which delegated to the NCUC certain responsibilities for determing each utility's avoided costs with respect to rates for purchases from qualifying cogenerators and small power production facilities. These proceedings are also being held pursuant to G.S. 62-156 which requires the NCUC to determine the rates to be paid by electric utilities for power purchased from small power producers as defined in G.S. 62-3(27a).
